- For the purpose of this Agreement:

- a)The term “territory” means, as regards the People’s Republic of China, all the territory of the People’s Republic of China in which the Social Insurance Law of the People’s Republic of China and other relevant laws and regulations apply, including its land territory, internal waters, territorial sea and the air space above them, as well as any area beyond its territorial sea, within which the People’s Republic of China has sovereign rights or jurisdiction in accordance with international law and its domestic law; andas regards the Kingdom of the Netherlands, the European part of the Netherlands, including its territorial sea and any area beyond and adjacent to its territorial sea within which the Kingdom of the Netherlands, in accordance with international law, exercises jurisdiction or sovereign rights;
- b)The term “legislation” means, as regards China, the laws, the administrative, ministerial, and local rules and regulations, and the other legal provisions concerning the social insurance systems covered by the scope of this Agreement in item i of Paragraph 1 of Article 2; andas regards the Netherlands, the laws and regulations specified in item ii of Paragraph 1 of Article 2;
- c)The term “Competent Authority” means, as regards China, the Ministry of Human Resources and Social Security; andas regards the Netherlands, the Minister of Social Affairs and Employment;
- d)The term “Competent Agency” means, as regards China, the Social Insurance Administration of the Ministry of Human Resources and Social Security or other bodies designated by the said Ministry; andas regards the Netherlands, the Social Insurance Bank or other bodies designated by the said Minister.

- Any term not defined in Paragraph 1 of this Article shall have the meaning assigned to it in the applicable legislation.
